Yorcation Properties - House Rules

These Terms are between you and us.

1. Definitions

When the following words with capital letters are used in these Terms, this is what they will mean:

Term	Meaning
Arrival Date	The date and time on which your Booking will begin and the Property will be made available to you.
Balance Due Date	14 days before your Arrival Date.
Booking	The confirmed reservation of the Property to commence on the Arrival Date and end on the Departure Date.
Booking Confirmation	The written acceptance from us of the Booking Reservation, which may include more information such as arrival and departure details, directions, House Rules etc.
Booking Price	The price of the stay as set out on our Website and confirmed in the Booking Confirmation.
Booking Reservation	Your request to book a Property.
Business Day	A day other than a Saturday, Sunday or public holiday in England when banks in London are open for business.
Contact Details	The details found on the Contact Us page of our Website and set out in all written communication between us and you.
Departure Date	The date and time on which your Booking will end and you must vacate the Property.
Events Outside of the Parties’ Control	As defined in clause 9.
Group	The named individuals attending the Property subject to these Terms.
House Rules	A separate document provided to you at the time of the Booking Confirmation and forming part of these Terms.
Permitted Pets	Pets permitted only at Properties where the listing expressly states that pets are allowed.
Property	The property provided for holiday letting purposes, details of which have been made available on the Website, including outside spaces belonging to the Property.
Security Deposit	A fee of £200 taken 7 days before the Arrival Date for group stays or stays over 4 nights.
Terms	These Booking Terms and any other documentation referred to within them.

We / our / us	Yorcation Ltd, Colenso House, Omega 1, Monks Cross Drive, York, YO32 9GZ.
You / your	The individual who makes the Booking Reservation, who must be over the age of 18.

When we use the words “writing” or “written” in these Terms, this includes email but not messaging platforms.

2. Our Contract With You

1. Please ensure that you read these Terms carefully and check that the details on the Booking are complete and accurate before submitting your Booking Reservation.
2. These Terms become binding once we issue your Booking Confirmation.
3. Your Booking is accepted only once we issue a Booking Confirmation.
4. The maximum number of guests permitted will be confirmed in the Booking Confirmation.
5. You agree not to arrive before the Arrival Date and to depart no later than the Departure Date. Additional charges may apply for late departure.
6. All imagery on the Website is for illustrative purposes only. Décor and layout may vary.
7. As lead guest, you are responsible for the actions and omissions of all members of your Group and any pets.
8. The Property is provided for holiday letting only. These Terms do not create a tenancy or any statutory rights under the Housing Act 1988.

3. Enjoying the Property

1. Access to the Property is subject to compliance with these Terms and the House Rules.
2. You agree to use the Property in accordance with all instructions and at your own risk.
3. You must take proper care of the Property and its contents. You may lose your Security Deposit and/or be invoiced for damage or loss.
4. Internet access is provided for recreational use only and is not guaranteed.
5. Recommendations for third-party services are personal suggestions only and not guaranteed.
6. It is your responsibility to ensure the Property is suitable for your needs before booking.
7. We may require your immediate departure without refund if you act unreasonably, illegally, immorally, or in a way that risks damage or disturbs others.
8. We or our representatives may enter the Property at reasonable times for inspection or repairs.
9. All belongings and vehicles are left at your own risk.
10. There is no electric vehicle charging facility at any Yorcation Property. Portable domestic chargers, trickle charging, and plugging into any domestic socket for the purpose of charging an electric vehicle must not be used and is not permitted.
11. Third-party providers (e.g., chefs, entertainers) are not permitted without our prior written permission.

4. Pets

1. Pets are only permitted at Properties where the listing expressly states that pets are allowed.
2. If you bring a pet to a Property where pets are not permitted, we may require immediate departure without refund.
3. We may require departure if a pet is deemed a nuisance or danger.
4. You are liable for any damage caused by pets or parasites introduced by them.
5. We are not liable for allergies triggered by previous pet occupancy.

5. Price and Payment

1. The Booking Price is based on your Booking Reservation and confirmed in your Booking Confirmation.
2. No Booking Deposit is required.
3. Full payment is required 14 days before the Arrival Date.
4. For bookings made within 14 days of arrival, full payment is required at the time of booking.
5. No entry to the Property will be permitted without full payment.

6. Our Liability to You

1. Nothing in these Terms limits liability where unlawful to do so.
2. To the fullest extent permitted by law, we shall not be liable for any loss, damage, cost or expense suffered by you, except where such loss arises directly from our failure to provide the Property in accordance with these Terms.
3. We are not liable for transport costs, alternative accommodation, or any business-related losses.
4. The Property is for private use only; we are not liable for loss of profit, business interruption, or loss of opportunity.
5. We are not liable for loss or damage to your belongings, pets, or vehicles.

7. Your Rights to Cancel

1. We strongly recommend that you take out comprehensive travel insurance at the time of making your Booking Reservation.
2. You may cancel by contacting us in writing.
3. Cancellation charges:
   More than 14 days before the Arrival Date: Full refund.
   14 days or less before the Arrival Date: 100% of the Booking Price payable.
4. If you cancel, we may attempt to relet the Property, but this does not affect the cancellation charges.
5. Illness, self-isolation, travel delays, or personal circumstances are treated as cancellations by you.
6. Early departure or failure to arrive is treated as a cancellation on the Arrival Date.

8. Our Rights to Cancel

1. We may cancel due to an Event Outside of the Parties’ Control.
2. If we cancel, all amounts paid will be refunded.
3. We may cancel with immediate effect if you fail to pay or materially breach these Terms or the House Rules.
4. No refund is due if cancellation occurs due to breach.

9. Events Outside of the Parties’ Control

1. Neither party is liable for failure to perform obligations caused by events beyond reasonable control.
2. These include strikes, civil unrest, pandemics, extreme weather, utility failures, or infestations.
3. If such an event prevents provision of the Property, a refund will be arranged.

11. Changes to Booking or Terms

1. We may revise these Terms from time to time.
2. We will give at least 14 days’ notice of changes where possible.
3. Booking changes may incur additional charges.

12. Other Important Terms

1. We may transfer our rights and obligations under these Terms.
2. No other person has rights under these Terms.
3. Each clause operates separately.
4. Failure to enforce rights does not waive them.
5. These Terms are governed by the law of England and Wales.
6. You may bring proceedings in England, Wales, Scotland, or Northern Ireland depending on your residence.
